Terms and Conditions – The Pick Ten

1. Acceptance of Terms
By accessing and using thepickten.com (the “Website”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you may not use the Website.
2. Account Registration and Multiple Account Prohibition
2.1 Account Requirements
- Users must register for an account to participate in The Pick Ten tournament
- Each user is permitted to create and maintain only ONE account
- Account registration requires accurate and complete information
- User must be 18 years old or older to create an account and receive prizes
- Age verification will be required before the user can receive a prize
2.2 Multiple Account Policy
- PROHIBITED: Creating, maintaining, or using multiple accounts is strictly forbidden
- CONSEQUENCE: Users found to have multiple accounts will be immediately disqualified from the tournament and forfeit all accumulated points, winnings, and eligibility for prizes
- DETECTION: We employ various methods to detect multiple accounts, including but not limited to IP address monitoring, device fingerprinting, and behavioral analysis
- NO APPEALS: Disqualification for multiple accounts is final and non-appealable
3. Game Description and Rules
3.1 The Pick Ten Tournament
The Pick Ten is a Pro Football Pick’em Tournament with a gambling-style point system where:
- Players choose winners of ten selected games each week
- Players place point bets on games using virtual currency (not real money)
- This is a game of skill and entertainment only – no real money gambling
3.2 Weekly Gameplay
Making Picks:
- Players must log in to view the current weekly pick with 10 legs
- Choose option A or B for each leg
- Wager points on each leg (minimum 1 point per leg)
- View points balance and total pool information
Game Rules:
- Must select an option and wager on ALL 10 legs
- Up to 10 submissions allowed per player per week
- Picks lock 5 minutes before start of the first leg
- Winners share the pool for each leg proportionally based on their wagers
- In the event of a Tie, both options will be considered a win with all wagers returned and no Jackpot contribution taken
3.3 Tournament Qualification
- Players must participate in at least 14 of the 18 weeks to qualify for Tournament and Jackpot payout
- Players are allowed 4 Bye weeks for the Tournament
- To take a Bye week, simply don’t make a submission for that week
4. Points and Wagering System
4.1 Point Structure
- Starting Points: Each player begins with 2,000 points
- Wagering: Players wager points on each leg (minimum 1 point per leg)
- Prize Pools: All wagers for each leg create that leg’s prize pool
- Jackpot Contribution: 10% of all wagers automatically go to the progressive jackpot
4.2 Payout System
- Parimutuel Style: Payouts follow parimutuel betting principles
- Pool Distribution: Winners of each leg share that leg’s pool proportionally based on their wagers
- No Winners: Legs with no winners add their entire pool to the jackpot
- Remaining Funds: Any remaining funds after payouts go to the jackpot
- Pick’em Bonus: Players choosing correctly on all 10 legs receive 1,000 bonus points from the jackpot (maximum one bonus per week regardless of winning submissions). A Tie will be considered a Win for that leg in respect to the Pick’em Bonus
4.3 Payout Calculation Example
If Leg 1 has 100 total points in the pool and 3 players chose the winning option with wagers of 10, 20, and 30 points:
- Total winning wagers: 60 points
- Share value: 100 ÷ 60 = 1.67 points per wagered point
- Payouts: 16, 33, and 50 points respectively (floor rounded)
5. Scoring and Rankings
Players are scored on three metrics:
- Return on Investment (ROI) = Winnings/Bets
- Total Balance
- Correct Picks
6. Jackpot and Prize Distribution
6.1 Progressive Jackpot
- Grows with every wager throughout the season
- Fed by 10% takeout from all win pools
- Paid out at end of season according to ranking
6.2 Jackpot Payout Structure
- 1st ROI: 35% of Jackpot
- 2nd ROI: 25%
- 3rd ROI: 15%
- 1st Balance: 5%
- 2nd Balance: 5%
- 3rd Balance: 5%
- 1st Correct Picks: 2.5%
- 2nd Correct Picks: 2.5%
- 3rd Correct Picks: 2.5%
- 4th Correct Picks: 2.5%
6.3 Prize Auction
- Physical prizes will be auctioned at the end of the season
- Players bid on prizes using their accumulated points
- It is a Player’s responsibility to verify they are eligible to receive a prize before they bid on it
- Age verification will be required before a Player can receive a prize
- If a Player is found to be ineligible to receive a prize they won, it will be considered a forfeiture of their right to a prize
7. User Conduct and Prohibited Activities
7.1 Prohibited Activities
- Creating multiple accounts
- Sharing account credentials
- Manipulating or attempting to manipulate the system
- Using automated tools or bots
- Providing false information during registration
- Engaging in any form of cheating or fraud
7.2 Consequences
Violation of these terms may result in:
- Immediate account suspension or termination
- Disqualification from tournament
- Forfeiture of all points and prizes
- Permanent ban from the Website
8. No Real Money Gambling
- The Pick Ten is a game for entertainment purposes only
- No real money is wagered or won
- All “bets” and “winnings” are virtual points with no monetary value
- Physical prizes may be awarded through the point auction system
9. Website Availability and Technical Issues
- We strive to maintain website availability but cannot guarantee uninterrupted service
- Technical issues affecting gameplay will be addressed on a case-by-case basis
- Picks must be submitted before the 5-minute lockout period
10. Privacy and Data Collection
- User information is collected and used in accordance with our Privacy Policy
- We may monitor account activity to detect violations of these Terms
- Personal information will not be shared with third parties except as required by law
11. Modifications to Terms
- We reserve the right to modify these Terms at any time
- Users will be notified of significant changes
- Continued use of the Website constitutes acceptance of modified Terms
12. Limitation of Liability
- The Website is provided “as is” without warranties
- We are not liable for any indirect, incidental, or consequential damages
- Our liability is limited to the maximum extent permitted by law
13. Dispute Resolution
- Any disputes will be resolved through binding arbitration
- Users waive the right to participate in class action lawsuits
